Why ELP Enforcement Data Matters

The Federal Motor Carrier Safety Administration (FMCSA) mandates that commercial motor vehicle (CMV) drivers demonstrate English proficiency under 49 CFR 391.11(b)(2) to ensure safe communication, understand traffic signs, and respond to official inquiries. Effective in June 2025, and pursuant to President Trump's executive order on the topic, non-compliance with the ELP rule will result in drivers being placed out-of-service (OOS), stranding freight and leading to delays.


As addressed in our detailed article on the topic, FMCSA's ELP enforcement policy leaves room for subjectivity in ELP enforcement, and it's yet to be seen how enforcement will play out across the U.S. While FMCSA publishes its enforcement data monthly, it does not segment ELP violation data in a particularly user-friendly fashion.
