In a 9–0 ruling, the Court held that the Federal Aviation Administration Authorization Act's (FAAAA) safety exception preserves state-law negligent-hiring claims against brokers — meaning brokers and shippers can no longer rely on FAAAA preemption as a complete defense to negligent selection claims brought against them.
